Introduction

 

The NRCPDS has produced several resources in response to the Fair Labor Standards Act (FLSA) Home Care Final Rule. This webpage is designed to be your one-stop location for information and resources about the FLSA Home Care Final Rule and it's impact on participant direction programs. Understanding the FLSA Home Care Rule and Litigation Webinar

This September 9, 2015 webinar provides an analysis of the Home Care Association of America v. Weil litigation and appellate court decision. The analysis includes timelines and likelihoods for the litigation's potential outcomes to help stakeholders best position their organizations for timely compliance. This webinar also helps stakeholders understand the key aspects of the Fair Labor Standards Act (FLSA) Home Care Rule, including the narrowed companionship exemption, the third-party regulation, and overtime andpaid travel time responsibilities of joint employers.

FLSA Homecare Final Rule Tool Kit

This tool kit is a resource for participant direction program stakeholders in response to new rules promulgated by the US Department of Labor (DOL) that will take effect January 1, 2015.  This is the first iteration of the tool kit.

FLSA Tool Kit Webinar

On September 8, 2014, the NRCPDS presented a webinar to guide attendees through the Fair Labor Standards Act Home Care Rule Toolkit. This webinar was led by Mollie Murphy from the Center but was joined on the call by James Toews, Senior Adviser at the Administration for Community Living, and Alison Barkoff, Director of Advocacy at Bazelon Center for Mental Health Law.
