Introduction to the Issues

Affirmative action admissions policies were struck down by the 5th US Circuit Court in Cheryl J. Hopwood v. State of Texas.

Four white plaintiffs claimed that the defendants discriminated against them by favoring less qualified black and Mexican American applicants -- as defined in part by their test scores -- for admission to the Univerity of Texas School of Law through the use of a quota system.

As a result of the decision, African American admissions to the School of Law dropped from 65 in 1996 to 5 in 1997, none of whom enrolled. Mexican American admissions dropped from 70 to 18 (Fields, 1997).

The Hopwood case has serious implications for affirmative action and for the use of standardized tests as college admissions criteria.
