[I]f death ensues from such [sports] as are innocent and allowable, the case will fall within the rule of excusable homicide; but if the sport be unlawful in itself, or productive of danger, riot or disorder, from the occasion, so far as to endanger the peace, and death ensure; the party killing is guilty of manslaughter.1 Hawkins Pleas of the Crown, ch. 15 (8th ed. 1824).
